Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Loffs: Puntgaaf, trading under
the name Loffs.

Consumer: a natural person acting for private purposes.

Distance contract: an agreement concluded via the webshop.

Product: all items offered via the Loffs webshop.

Right of withdrawal: the consumer's option to cancel a purchase within the legal
period.

Article 3 – Applicability

These conditions apply to every offer from Loffs and every
agreement made via the webshop.

By placing an order, the consumer agrees to these
conditions.

Article 4 – Offer

Loffs does its best to describe products as accurately as possible.

Colors, materials, or finishes may vary slightly due to
screen settings or the handmade nature of products.

Obvious errors in prices or descriptions are not binding on Loffs.

Article 5 – Formation of the
agreement

An agreement is formed as soon as:

  • the consumer places an order;
  • payment is completed;
  • an order confirmation has been sent.

Loffs reserves the right to refuse orders in case of suspected
abuse, incorrect data, or technical errors.

Article 6 – Prices and
payment

All prices are in euros and include VAT unless otherwise stated.

Shipping costs are displayed before the order is finalized.

Payment is made via the offered payment methods.

Article 7 – Delivery

Loffs processes orders carefully.

Delivery takes place at the specified address.

Delivery times are indicative.

If delivery takes longer than 30 days without an agreement to that effect, the
consumer may dissolve the contract.

The risk of loss or damage remains with Loffs until the product has been
delivered.

Article 8 – Returns,
right of withdrawal, and hygiene

Loffs sells handmade jewelry.

Due to the personal and hygienic nature of jewelry,
products can be affected after wearing, trying on, or use by, among other things:

  • perfume
  • creams
  • skin contact
  • make-up
  • moisture
  • wear and tear
  • stretching or deformation during fitting

This can lead to a decrease in value, meaning products can no longer be sold as
new.

Consumers must therefore handle received products carefully
during the cooling-off period.

If a product shows clear signs of use or has suffered a decrease in value
due to use, this decrease in value may be charged in accordance with legal regulations.

For personalized or specially customized products, the
right of withdrawal may not apply.

Complaints about incorrect delivery, damage, or defects will, of course,
always be handled.

stating the order number and photos if necessary.

Article 9 – Complaints

Complaints must be reported within a reasonable period after the defect
is discovered.

Loffs will respond within 5 business days.

If a complaint is found to be justified, an appropriate solution will be sought, such as:

  • replacement
  • repair
  • refund

Article 10 – Legal
guarantee

The consumer is entitled to a sound product.

Products must meet reasonable expectations.

Normal wear and tear, incorrect use, falling, pulling, or exposure to
perfume/creams are not covered by the warranty.

Article 11 –
Liability

Loffs is not liable for damage caused by:

  • incorrect use;
  • normal wear and tear;
  • careless use;
  • incorrect storage of jewelry.

Nothing in these terms and conditions limits statutory consumer rights.

Article 12 – Force majeure

Loffs is not liable for delays caused by force majeure
such as:

  • illness;
  • disruptions;
  • transport problems;
  • fire;
  • government measures.

Article 13 – Intellectual
property

All images, texts, designs, and product photos remain the property of
Loffs.

Use without permission is not permitted.

Article 14 – Privacy

Personal data will be processed in accordance with Loffs' privacy policy.

Article 15 – Changes to
terms and conditions

Loffs may change the terms and conditions.

For existing orders, the version valid at the time of purchase always applies.

Article 16 – Disputes and
applicable law

All agreements are exclusively governed by Dutch law.

Disputes will be submitted to the competent Dutch court.
